His appraisal assignments have included significant and complex assignments throughout the U.S. Mr. Roach holds a bachelor of science degree in real estate from San Diego State University, and he has extensive deposition and trial testimony experience. Mr. Roach is a contributing editor to numerous Appraisal Institute books, courses, and seminars. His Appraisal Institute teaching experience includes basic and advanced courses on income capitalization, litigation courses, and over 200 additional courses and seminars. In addition to teaching throughout the U.S. Mr. Roach has presented appraisal courses, seminars, or lectures in Switzerland, Germany, South Korea, Japan, China, and Mexico. What's the Value of a View of Area 51?
The Truth is Out There . . . The presentation will describe the saga of an acquisition through condemnation by the U.S. of a property within the boundaries of the National Test and Training Range in Nevada. Spanning a number of years, the pre-trial activities included a number of appraisals, appraisal reviews and work by additional experts on both sides. The extensive pre-trial work, including depositions, law and motion practice, sets the stage for the ultimate trial. We will discuss the valuation positions taken by the two sides, the results of pre-trial motions and their impact on the case and the final verdict, along with the reasoning of the commission that heard the matter. Finally, we will discuss some key takeaways from the story.

Denis DeSaixis has over 20 years of appraisal and consulting experience. Mr. DeSaix’s areas of expertise include complex appraisals, estate and portfolio valuations, consulting and expert witness services for the general public, attorneys, CPAs and mortgage lenders, review appraisals for banks and mortgage lenders, and forensic review work for attorneys and lenders. Denis is a designated member (SRA) of the Appraisal Institute. Denis DeSaix has been qualified as an expert witness for court testimony and has offered expert testimony for real property tax appeal hearings. He holds a Bachelor of Science Degree in Finance and is proud to have served as a United States Marine.

Daniel Doucet has been a member of the Appraisal Institute of Canada for 42 years. His career as a generalist began in Eastern Canada in 1982 covering assignments in all four Maritime Provinces. After 13 years with Altus Group Moncton, he relocated to the Toronto area in late 2016. Daniel has been involved in numerous high-profile assignments throughout Canada. His specialty is litigation and Expropriation assignments focusing on rural land and agricultural properties. Daniel’s has been declared an expert witness before various courts and tribunals in the field of real estate appraisal. Daniel also co-authored a five phase Study (2011 to 2021) titled, “Impact of High Voltage Transmission Lines on Rural Property Values in Ontario” and has presented the results of the study at eight conferences in Canada, the United States and in Paris, France. Over the past three years Daniel was one of two AIC members on the Steering Committee with AI and IRWA members who oversaw the publication the recently released textbook “Corridor Valuation: An Overview and New Alternatives”. Daniel spent six years on the Board of Directors of the Appraisal Institute of Canada culminating with the position of National President in 2015-2016. Daniel resides in the small town of Drayton, Ontario where he works as an independent valuation consultant with his partner, Alinda Dekker P.App., CRA.

Christina Thoreson is a valuation professional since 1986 and founder of Real Counsel, LLC, brings awealth of experience to her expert witness testimony, particularly in eminent domain. She is a Designated Member of the International Right of Way Association, Appraisal Institute, and the American Society of Appraisers with advanced credentials, including the SR/WA, MAI, SRA, AI-GRS, and CRE. Christina's leadership roles, such as serving on a Georgia County Board of Assessors, co-owning real estate brokerage firms, and working with the Tennessee Department of Transportation, highlight her diverse real estate background. As part of Cushman & Wakefield's executive leadership team for Dispute, Analysis, & Litigation Support (DALS), her appraisal and litigation support expertise is further solidified. A passionate educator, Christina holds the CDEI designation and is an AQB-qualified USPAP instructor with over 3,000 hours of continuing education and 1,000 hours as an instructor.

The Federal Highway Administration (FHWA) is holding several upcoming in-depth webinars regarding the final rule on the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (Uniform Act), which was published in the Federal Register on Friday, May 3, 2024. The final rule became effective June 3, 2024.
This final rule amends the government-wide Uniform Act regulations at 49 CFR part 24. The revisions were prompted by the Moving Ahead for Progress in the 21st Century Act (MAP-21), which increased statutory relocation benefits and reduced length of occupancy requirements. The FHWA also updated the Uniform Act regulations in response to comments received during the public comment period and to reflect FHWA’s experience with the Federal-aid highway program since the last comprehensive Uniform Act rulemaking, which occurred in 2005. The updates include streamlining processes to better meet current Uniform Act implementation needs and eliminating duplicative and outdated regulatory language. The final rule also includes important equity updates, including increases in the relocation benefit levels to account for inflation.

As Energy & Outreach Administrator for the City of Irvine’s Environmental Programs Division, Selene is working to develop the City’s first Climate Action & Adaptation Plan, as well as citywide policies and programs to achieve decarbonization across buildings, transportation and energy. Her career experience includes working as a Government Affairs liaison for the solar and recycling industries, as well as the New York City Department of City Planning, where she participated in a citywide inter-agency initiative to produce resiliency planning for New York City areas threatened by climate change, specifically sea-level rise. Her career has spanned the private, nonprofit and public sectors to achieve climate action and environmental conservation through policy, stakeholder engagement and community action.

This presentation by the Allen Matkins eminent domain practice group will focus on a property owner’s perspective on settling eminent domain cases before trial. The presentation will include strategies that owners and public agencies can utilize to successfully reach negotiated settlements and pitfalls to deal making that agencies might want to avoid.

For more than 30 years, Rick has been representing landowners, developers, businesses, and public agencies in some of California’s biggest eminent domain, inverse condemnation, land use, and other real estate deals and disputes. Rick has an unrivaled understanding of how to navigate complicated eminent domain and land use issues, and clients regularly seek his counsel on acquisition deals, valuation, and on land planning and entitlement issues.

While Rick is an exceptional litigator, he employs a strategic approach to finding successful resolutions for his clients early in the process, avoiding costly litigation whenever possible. His extensive and comprehensive knowledge of this narrow space, coupled with his experience and understanding of how the regulatory environment and infrastructure impacts land use, allow Rick to strategically negotiate multimillion-dollar deals for clients across a variety of industries. Nazani has experience in all aspects of the litigation process including pre-filing strategy, drafting and responding to pleadings and motions, discovery, and mediations. She brings enthusiasm and attention to detail to all of her cases, which maximizes the client's opportunity for a successful outcome.

Brian is an associate in the Orange County office who represents clients in commercial litigation matters, with a focus on real estate and eminent domain disputes. The carbon market is a hot topic we are all hearing about. Land professionals are working on more carbon sequestration pipelines and projects supporting carbon injection/storage technologies, and work is not slowing down anytime soon. Land professionals providing appraisal, right of way negotiations and mineral rights services will benefit from diving in deeper to better understand the basics of what carbon capture, utilization and storage (CCUS) is, why and how more industries and governments are wanting to utilize and improve the technologies for CCUS, the current general status of CCUS and what is hoping to be achieved by implementation of CCUS.
The carbon industry is multipronged and interconnected with a variety of other industries such as the energy industry, chemicals, agriculture, transportation, steel and cement. The public and political concern over greenhouse gas (GHG) emissions and the impacts on global climate change has led many countries and companies to a push for a net zero emissions environment. |
According to the World Economic Forum, human-made CO2 emissions need to fall 45% by 2030, and the world needs to reach net-zero by 2050 to stand a chance of limiting global warming to 1.5°C, as agreed in the 2015 Paris climate summit. Reaching this net-zero state would require removing all GHG emissions, of which CO2 makes up the majority (carbon storage).
Reaching a carbon neutral state would require the use of carbon offset programs to remove the same amount of carbon-only emissions as the amount produced (e.g., carbon capture/sequestration and utilization). Our panel of carbon experts will share their knowledge and experiences so you can be better prepared to talk to landowners, clients and colleagues when they ask questions about carbon capture, sequestration, storage and utilization. |

Planning for major capital improvement projects can often begin years, or even decades before construction commences. Throughout the planning, design, and environmental review process, right-of way professionals are called upon to help analyze the need for additional property and rights to construct projects, and to estimate costs to obtain those rights. For regional scale “mega projects”, affected properties can number in the dozens to hundreds (or more) requiring detailed studies of the impact to properties and displaced uses.
To provide the information necessary to evaluate right-of-way impacts as part of the overall design and environmental process, right-of-way professionals have begun to adopt new technologies, allowing them to readily exchange critical data with engineers, planners, oversight agencies, local agency stakeholders, and the public. The use of Geographic Information Systems (GIS) specifically has paved the way for unprecedented collaboration among these project partners and enabled right-of-way professionals to provide meaningful insights to the project development process that can help minimize unnecessary impacts to existing infrastructure. |
In addition to helping identify right-of-way requirements and minimizing impacts, GIS has helped analysts develop estimates of the likely cost to obtain property and rights early in the project development process. Especially in regions where real estate can be a significant portion of the overall project cost, these estimates have proven invaluable for assessing overall project feasibility, applying for funding, and programming funding for future project phases.
This presentation will provide insights into the adoption of GIS technology by right-of-way professionals and provide examples of integrating the technology into the planning process for large infrastructure projects. The presentation will highlight some of the advantages to using GIS as part of the planning process, discuss some of the challenges to implementing these systems, and discuss other considerations for teams who may wish to adopt this technology for their projects. |

He is a graduate of UCLA with a degree in Business Economics and is a member of IRWA Chapter 1. John is also a past president of the Southern California Chapter of the Appraisal Institute, and received the Chapter’s Lifetime Professional Service Award in 2018. He has testified in Federal and Superior Courts on appraisal issues in more than 30 cases, in addition to testifying at many other hearings and arbitrations. He is a frequent speaker and guest lecturer on economic conditions and various topics relating to real estate valuation. |

He will review the history and function of amicus briefs by way of background and discuss the specifics of a recent amicus brief filed on behalf of IRWA in a case in the North Carolina Court of Appeals, which involves the finality of settlements in right of way cases. |

Mr. Anderson is considered a local to global practitioner and scholar who has written and published over 125 articles. He has authored, developed, and presented over 50 seminars, programs, conferences, and continuing educations courses for the IRWA, the Appraisal Institute and the American Bar Association. Mr. Anderson has contributed to and or written eight books about real estate appraisal and property value damages. His most recent journal article was just published in the Appraisal Journal on PFAS contamination and residential property value diminution in five geographies in the United States, which is the subject of his IRWA presentation.

Mr. Anderson was the former president of Orange County’s Chapter 67 in 2004 and then again in 2007 as well as the IRWA’s International Valuation Committee Chair in 2017 and 2018. In addition to his professional life, he is also an enthusiastic artist and photographer, a collector of ancient Viking artifacts and a really bad golfer.
